“Hello Kitty Dream Village” Terms and Conditions

cocone ONE Corporation (hereinafter, “this company”) has adopted these Terms and Conditions for the application software Hello Kitty Dream Village (hereinafter, “this app” or “Dream Village”). These terms and conditions govern the relationship, including rights and obligations, between this company and the customer.

A. Introduction

  1. Agree to Terms and Conditions
    • The purpose of this agreement is to define the rights and obligations between this company and the customer regarding the use of Hello Kitty Dream Village. It therefore applies to the relationship between this company and the customer. Regulations that are stipulated and shared by this company, including the Cocone Global Privacy Policy, constitute a part of these Terms and Conditions, and the customer shall use Hello Kitty Dream Village after agreeing to these Terms and Conditions in advance. If you do not agree to these Terms and Conditions, you will not be allowed to use Hello Kitty Dream Village and should cease using this app immediately. The customer is considered to have agreed to these Terms and Conditions when the customer uses this app.
  2. On Minors
    • If you are legally underage, please use Hello Kitty Dream Village with the consent of a legal guardian (parental authority, etc.). The same applies to those who do not have the ability to perform legal acts independently (hereinafter, ‘minors’). If you are underage, you cannot use Hello Kitty Dream Village without the consent of a legal guardian. If you are using Hello Kitty Dream Village without guardian consent, you will not be allowed to use Hello Kitty Dream Village and should cease using this app immediately. The use of Hello Kitty Dream Village by a minor is considered to have been undertaken after the minor was granted consent from a legal guardian.
  3. Application of the Terms and Conditions
    • Even if it is determined that a part of these Terms and Conditions is invalid under the law, other provisions of these Terms and Conditions will remain valid. In addition, even if all or part of this agreement is invalidated or canceled in regards to a specific customer, this agreement will still be considered valid in regards to other customers.
  4. Changes to Terms and Conditions
    • This company may make changes to Terms and Conditions at any time without customer consent.
      • When the changes to these Terms and Conditions are in accordance with the general interest of the customer.
      • When the changes to these Terms and Conditions do not violate the purpose of the contract and are reasonable in light of the necessity of the change
    • We will notify you in the “Notice” section within the app after making changes to the Terms and Conditions. Included in the Notice may be information regarding changes, reasons for any changes, content of the Terms and Conditions that were changed, and when the changes go into effect.
    • If the customer continues to use Dream Village without expressing any refusal to abide by amendment(s) to these Terms and Conditions 7 days after such amendment(s) are announced, they shall be deemed to have agreed to the new Terms and Conditions.

B. Ownership of Copyrights and Other Rights

  1. All rights, including but not limited to intellectual property rights and copyrights, related to Hello Kitty Dream Village belong to this company or third parties holding legitimate authority.
  2. This company provides items, including but not limited to avatars, avatar outfits, decorations, and other items contained within Hello Kitty Dream Village (hereinafter referred to as “customer-related content”). This company lends customer-related content to customers of this app for use exclusively within Dream Village. Furthermore, even if customers create combinations of customer-related content, such as avatar outfit coordinations, decorations, or similar works, the ownership of all rights, including but not limited to copyrights for all individual customer-related content and their combinations shall remain with this company or third parties holding legitimate authority. By using the app, customers are deemed to have agreed to and to comply with these Terms and Conditions.
  3. Customers are prohibited from using Hello Kitty Dream Village in any form beyond its current configuration. Any act that infringes upon the rights of this company, including but not limited to copying, editing, modifying, analyzing, publishing, broadcasting, exhibiting, distributing, transferring, renting, translating, adapting, transmitting, reprinting, recording, sub-licensing, or registration of or application for rights in relation to all or any part of Hello Kitty Dream Village without this company’s explicit permission, is strictly prohibited.
  4. Hello Kitty Dream Village includes a feature that allows customers to exchange customer-related content with each other. The customer-related content available for exchange on this app continues to belong to this company or third parties holding legitimate authority, and such exchanges do not grant any additional rights, including but not limited to ownership, to the customers involved. This company is not responsible for nor involved in any actions related to the exchange of customer-related content that occurs outside of the specific function within Hello Kitty Dream Village provided by this company.

C. Responsibility of Customer

  1. You agree to use Hello Kitty Dream Village at your own risk and to take full responsibility for all actions, consequences, and damages entered into while using Hello Kitty Dream Village, except when we are responsible for such liabilities under law.
  2. Customers shall use Hello Kitty Dream Village of their own free will (in the case of minors, after having been granted express permission by a legal guardian) and monitor their use. In the case of violations of the rights of third parties (including corporations) or in the case of disputes, the problem must be resolved at the customer’s own risk and expense. This company does not take responsibility.
  3. The following cases are considered infringement on the rights of other customers;
    • Defamation of others
    • Slander, or insults directed at others
    • Infringement on the privacy of others (example; disclosure of information that can identify and individual, such as name, address, telephone number, school, or organization)
    • Infringement of another person’s copyright, trademark right, likeness, etc.

D. Prohibited Activities

When using Dream Village, customers are strictly prohibited from engaging in any of the following activities:

  1. Using Dream Village in any manner that is not expressly approved by this company.
  2. Displaying information, content, or video clips on Dream Village including any of the following items.
    • Material that infringes on third-party rights, such as copyright, trademark, privacy, likeness, or similar rights, including posts made with the intention of infringing upon these rights.
    • Material that discloses personally identifiable information of a third party (including, but not limited to, names, nicknames, email addresses, physical addresses, phone numbers, or affiliation with schools or organizations.
    • Material that violates applicable laws or is deemed pornographic, sexually explicit, obscene, or otherwise inappropriate by this company.
    • Violent or otherwise grotesque imagery that is deemed offensive or disturbing to customers by this company.
    • Content that induces and promotes violence, cruelty, or crime towards or among children and adolescents and that hinders or undermines their sound development.
    • Content that violates laws and regulations, public order, or moral standards.
    • Expressions promoting or leading to discrimination based on race, nationality, creed, gender, gender expression, social status, or similar characteristics.
    • Any expressions that induce or encourage suicide, self-harm, substance abuse, or illegal drug use.
    • Inappropriate expressions such as slander, complaints, or discriminatory remarks against this company or any specific company, corporation, group, region, or individual.
    • Spam messages, including repeatedly posting the same or similar content and displaying such messages on Hello Kitty Dream Village.
    • Attempts to connect or engage in interactions with others through the app for improper, unethical, or unsuitable purposes.
    • Content that benefits anti-social forces or engages in any form of cooperation with such groups.
    • Any other content that this company considers inappropriate in light of the Terms and Conditions of Hello Kitty Dream Village.
  3. Guiding or soliciting customers towards other companies’ apps or services for profit or purposes not permitted by this company’s Terms and Conditions.
  4. Modifying, disassembling, decompiling, or reverse engineering Hello Kitty Dream Village.
  5. Using emulators, mods, unofficial software, non-genuine software, or application mods.
  6. Exploiting or spreading defects of Dream Village for novelty purposes or intentionally triggering such defects.
  7. Use of Dream Village for commercial purposes or profit making rather than for personal enjoyment.
  8. Engaging in acts that violate the copyright, trademark, privacy, likeness, honor, or other rights of this company or any third party.
  9. Exchanging Dream Village usage rights with cash or cash equivalents, other economic benefits, or the usage rights of other customers in any manner not permitted by this company.
  10. Engaging in acts that violate laws, public order, or morals or breach these Terms of Use.
  11. Any other actions that this company considers inappropriate in connection with the operation of Hello Kitty Dream Village.

E. Disclaimer

  1. This company does not guarantee the accuracy, validity, applicability, usefulness and operation of Hello Kitty Dream Village, including any other matters. In the event that the customer suffers any problem relating to Hello Kitty Dream Village, this company will not be liable for any damage caused to the customer or to any third party to the extent permissible under law, unless the damage is deemed intentional or due to gross negligence on the part of this company.
  2. To the extent that this company has a justifiable reason, it may change or discontinue all or part of the services provided by Hello Kitty Dream Village at this company’s discretion or the discretion of a third party with legitimate rights without prior notice to the customer. In this case, even if the customer suffers damages related to Hello Kitty Dream Village, this company will not be liable for the damages.

F. Customer Responsibilities

  1. Customers should comply with relevant laws and regulations relating to Hello Kitty Dream Village (including the Foreign Exchange and Foreign Trade Law).
  2. In order to ensure that customers use Dream Village without any problem, this company may view customer content and contributions to this app (including posts on timeline, community posts, profile information, etc.) in order to ensure compliance with relevant laws and regulations. However, we are not obligated to confirm the status of your compliance with these Terms and Conditions.
  3. Customers are held liable for compensation regarding any damage caused to this company or a third party as a result of violation of these Terms and Conditions.
  4. If we find that the customer is in violation of these Terms and Conditions, we may take appropriate measures to correct the violation upon notifying the customer in advance. Appropriate corrective actions include, but are not limited to:
    • Caution, warning, notification to authorities, etc.
    • Rescindment of customer ability to post content, or making the post invisible to other customers
    • Deletion (or suspension) of any or all of the customer’s content.
    • Suspension or closing of the account.
    • Restriction, suspension or deprivation of all or part of rights of use
    • Restriction or withdrawal of all or part of currency (coins, etc.) in the app
    • Ranking change
    In addition, all or part of the customer’s right to use Hello Kitty Dream Village may be lost, and this company will not be liable for any disadvantage caused to the customer. Also, if a customer account is deleted, the customer will lose all rights to use Dream Village and they will not be able to recover their account.
  5. If more than one year has passed since a customer last logged into Hello Kitty Dream Village, this company may take steps such as deleting or suspending the account.

G. Prohibition of Transfer of Rights and Obligations

The customer must not assign or pledge their position as a customer and any rights and obligations based on that position to a third party unless this company has given consent to do so.

H. In-app Currency (coins, etc.)

  1. Customers can purchase in-app currency that can be used within Hello Kitty Dream Village. The purchase unit price of the in-app currency is decided by this company and can be changed without prior notice to the customer. In the United States, if the Customer is under 16 years old, such Customer must obtain consent from a parent or guardian before purchasing any In-App Currency.
  2. We may grant in-app currency to customers free of charge due to campaigns. If there are paid in-app currencies and free in-app currencies, the free in-app currencies will be consumed first.
  3. Customers must not exchange in-app currencies with other currency, or exchange cash or other economic benefits.
  4. In-app currencies cannot be refunded for any reason. However, this does not apply if the refund is legally required.
  5. For customers who failed to log in for over one year, this company reserves the right to redeem any remaining in-app currency without the consent of the customer.

I. Privacy

We handle your private information appropriately in accordance with the Cocone Global Privacy Policy. We will do our best to safely manage the information obtained from our customers.

J. Regulations

In addition to these Terms and Conditions and the Cocone Global Privacy Policy, this company may establish and publish any additional policies, regulations, and rules when providing services. Added regulations will be applied to customers who use Hello Kitty Dream Village from the time of announcement.

If some or all of the provisions are found to be invalid, illegal, or unenforceable, only those parts that are deemed invalid, illegal, or unenforceable will be invalidated.

K. Governing Law

Japanese law shall apply to the establishment, effect, performance, and resolution of these Terms and Conditions.

L. Court of Jurisdiction

In the case of filing a lawsuit related to any dispute concerning these Terms and Conditions, the Tokyo District Court shall be the exclusive jurisdiction court of the first instance.
